What is Ohio Issue 1?

Ohio Issue 1 has been the talk of the town, but what does it truly mean for the residents of Ohio? Fact Check

Beth and Kyle Long lost a child to a rare fetal disorder. That is a tragedy. Ohio law protected her right to end that pregnancy. The Long’s claim they had to go out of state because her insurance did not cover therapeutic abortion. So she has become a spokesperson for Issue 1. But Issue 1 does not address insurance. It never mentions the word. Is anyone ever going to fact check this story?

Why is this important?

A pro-abortion coalition is bringing a Constitutional Amendment to Ohio, which, for the first time in American history, attempts to create a new human right called the right to "reproductive decisions." The legal construction of this Amendment is lengthy, yet it lacks a section where the new terms are thoroughly defined. This has created a significant number of questions for Ohio voters.

It is essential that all Ohio voters have the opportunity to fully review and understand the ramifications of this Amendment. The Ohio Constitution is the controlling legal authority over all forms of state and local law. The Ohio General Assembly cannot pass a bill that alters or bypasses the words of the Constitution. So the accurate meaning of every word of this proposed Amendment truly matters. If passed by the voters, the words of this Amendment will be binding upon all the people living in Ohio. 

The actual language of the full Amendment is presented above. A second version is presented including questions based upon research regarding the legal ramifications of the language. This research was conducted by the staff of the American Policy Roundtable, a non-profit, non-partisan organization founded in Ohio in 1980.

Is Issue 1 a power grab by the abortion industry?

The right of reproductive decisions in Issue 1 is actually five specific rights. Abortion is the fifth right. Why are the other four "rights" being placed in the state constitution? The practices of "contraception, fertility treatment, continuing one's own pregnancy and miscarriage care" are not being denied in Ohio today. Why do they appear as new human rights in the language of Ohio Issue 1?

Viability

The proposed amendment states that abortion “may be prohibited after fetal viability.” Note: the words do not say “shall be prohibited.” So this action may or may not be attempted by the Legislature at some future point. However, the amendment continues by declaring that “in no case” may an abortion be prohibited if, in the judgment of the treating physician, the abortion is deemed necessary based on the criteria of the patient’s life or health. The meaning of “health” is left wholly undefined.

Are Ohio Abortion Laws Broken?

Issue 1 backers have been running commercials claiming, “Abortion laws are broken in Ohio” and “Passing Issue 1 is the only way to fix this.” They claim that “The Government” has taken away the right of abortion in the very rare and difficult cases where a medical emergency places the life and health of the mother at risk.

This is not the case in Ohio law.

What is the actual language I will see on my ballot?

The actual permanent text of the Constitutional amendment is different from the wording that you will see printed on your ballot. For every constitutional amendment, on any issue, state law requires that the Ohio Ballot Board has the final say on the description language that will appear on your ballot. (Ohio Revised Code 3505.062)

Voting on Issue 1 begins October 11th
